First Phase Regulation Notice to Members
As CCI Members are aware, The Protecting Condominium Owners Act, 2015 ("PCOA") received Royal Assent on December 3, 2015, marking the first overhaul of the province's condo law in over 16 years. This legislation will not be proclaimed into force until the Regulations are finalized.
The plain English summary as well as the full text of the draft Regulations of the proposal for the first phase regulations has recently been posted by the Ministry for public consultation. This phase of regulation amendments primarily addresses condo board governance – specifically in the areas of Communications, Director Qualifications and Disqualifications, Meetings and Records.
The ministry is proposing to have many of these proposed regulatory changes, and related Condominium Act amendments, come into force on July 1, 2017.
The ministry welcomes feedback and encourages anyone interested to provide comments on the proposal by e-mail or mail by March 30, 2017. For further details or to view the proposal, please click here.
The CCI-T Legislative Committee will be reviewing the proposed regulations and providing feedback on behalf of our members.
We will keep members posted when further phases of regulatory changes are posted for public consultation.
